NICEIC reserves the right to modify these Terms & Conditions at any time.
These terms, including the Website Terms of Use (and any other terms referenced below), apply to your use of the job board which is accessible via our website at futures.niceic.com (the Job Board).
Please refer to the NICEIC Code of Conduct, which also applies to you in relation to your accreditation as an NICEIC Certified Business.
If you do not agree to any of these terms, do not use the Job Board.
The Job Board allows NICEIC Certified Businesses to post apprenticeship opportunities for individual users to view and apply for. Individual users can view and contact the relevant NICEIC Certified Businesses in relation to opportunities listed on the Job Board. NICEIC Certified Businesses can also respond and contact individual users through this platform.
The Job Board is available free of charge for NICEIC Certified Businesses, in accordance with these terms.
For the purpose of these terms, a 'NICEIC Certified Business' means a business, which has been assessed in accordance with the relevant scheme rules and has received the stated accreditation (subject to clause 6.3) and has posted an apprenticeship opportunity on the Job Board (referred to as You, Your, or NICEIC Certified Business in these terms).
These terms outline how the Job Board functions.
1 Who we are and how to contact us
1.1 The Job Board is made available by Certsure LLP (trading as NICEIC) ('we, our, us, Certsure'), with company number OC379918, registered in England with registered address: Warwick House Houghton Hall Park, Houghton Regis, Dunstable, Bedfordshire, LU5 5ZX.
1.2 If you have any comments, queries or suggestions, you can contact us via email customer.services@niceic.com, by calling 0333 015 6625, or by visiting our Contact Page.
2 Other terms apply
2.1 The following additional terms apply to your use of the Job Board:
2.1.1 NICEIC Scheme Rules , which sets out the basis on which we assess and accredit you as a certified business, including any other rules or terms referenced therein;
2.1.2 Website Terms of Use, which sets out the general terms governing your access and use of any page on our site (including the Job Board);
2.1.3 Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us; and
1.1.4 Cookie Policy, which sets out information about the cookies on our sites.
3 How the Job Board works
3.1 You will need to complete a basic registration process in order to post an apprenticeship opportunity on the Job Board.
3.2 To post an apprenticeship opportunity on the Job Board, you need to provide all relevant requested information about your apprenticeship opportunity.
3.3 The Job Board is free for your own use in accordance with these terms and it is free for the individual users to use too.
4.4 The Job Board helps introduce individuals to NICEIC Certified Businesses that offer apprenticeship opportunities. We receive no commission based on whether an individual obtains an apprenticeship via the Job Board or not.
3.5 To post an apprenticeship opportunity on the Job Board, you must provide certain requested information. This may include:
3.5.1 details of the opportunity;
3.5.2 your contact information and/or application links; and
3.5.3 any other information reasonably needed for the purposes of presenting an apprenticeship opportunity.
3.6 Subject to the other disclaimers set out in these terms, we do not guarantee that any prospective apprentices will contact you via the Job Board or that they will meet any standards you may require.
3.7 Apprenticeship opportunities posted on the Job Board will expire and automatically be removed after 30 days.
4 Job Board listings and ranking
4.1 There are no preferential listings, or other paid ranking system underlying the opportunities presented on the Job Board. The apprenticeship opportunities are listed in the order of most recently posted if a user is just browsing, or in order of how closely they match the user's search criteria if they are making a search. Certsure does not make any recommendations about apprenticeship opportunities appearing on the Job Board.
4.2 The apprenticeship opportunities listed on the Job Board must include basic details of the relevant NICEIC Certified Business and what you are offering. This is prepared by you, not Certsure. Certsure cannot therefore be responsible, and is not responsible, for the accuracy or reliability of any content posted on the Job Board. You must provide further information about the apprenticeship opportunity directly to the relevant user which there will be a facility to do via the Job Board, if you proceed with them. We make no promise that any user will engage with you outside of the Job Board or that they will meet your requirements.
5 Handling enquiries
5.1 An individual user of the Job Board may contact you using your details available on the Job Board, to apply to or to find out more about an apprenticeship opportunity you posted on the Job Board.
5.2 You agree to provide the requested information promptly in order for the individual to consider your opportunity and to apply to you if they choose.
5.3 We do not guarantee that a user will contact or respond to you, or accept any apprenticeship you may offer.
6 Decision to undertake an apprentice
6.1 It is a matter for you and the relevant individual to decide between yourselves whether to work together. You will be the one to decide whether to offer an apprenticeship opportunity and on what terms. You are not obliged to enter an apprenticeship based on an application alone and if you do engage with a user, that is a matter for you and them to agree and to formalise between yourselves, not Certsure.
6.2 Any apprenticeship opportunity you provide, is subject to your relevant terms and internal processes in relation to how you administer apprenticeships. Certsure is not involved with this or any other aspect of the apprenticeship.
6.3 We can only present specified credentials of you as an NICEIC Certified Business at the time of live viewing the Job Board (subject to the remainder of this clause). In between the time a user initially views the Job Board, and making a decision to contact a NICEIC Certified Business (or thereafter) it is possible that you leave our register of accredited businesses, or are suspended, or otherwise lose any relevant accreditation. It is also possible that a NICEIC Certified Business is no longer on our register (or has lost a relevant accreditation) despite its continued appearance in the Job Board due to a lag or delay in updates being applied to the Job Board.
6.4 You acknowledge and agree that it is your responsibility to carry out your own due diligence to satisfy yourself that a prospective apprentice meets your requirements, including that they comply with any credentials or other requirements and that they are otherwise right for you. Certsure does not vet or otherwise vouch for any prospective apprentices. Certsure does not make any guarantee that they will perform or meet any service level during their apprenticeship or in their conduct with you.
6.5 Notwithstanding any actions carried out by us in relation to any user, or NICEIC Certified Businesses, we do not represent or act as agent in relation to any NICEIC Certified Businesses, or any user.
6.6 Certsure is specifically not responsible for:
6.6.1 the accuracy, quality, safety or legality of any individual user, or that any information they communicate to you is accurate, or their acts or omissions;
6.6.2 whether and how any apprentice (prospective or actual) co-operates with you or responds to your correspondence;
6.6.4 so far as is permitted by law, any liability, loss, damage, injury, cost, expense, fine, demand, claim or proceeding incurred by any person whatsoever in connection with your use of the Job Board and/or any interaction or engagement of any kind with any apprentice (prospective or actual).
7 Access and service level
7.1 We provide free access to the Job Board on an 'as is' basis, without any warranty or guarantee whatsoever, including as regards minimum uptime or downtime. We may take the Job Board down permanently, or suspend it temporarily, at any time for any reason.
7.2 We make no guarantee that the Job Board will be accurate or up to date, uninterrupted or error-free, or that results will meet your requirements.
7.3 We do not guarantee that any apprentices (prospective or actual) you engage will comply with any standards, rules, quality levels codes, or regulatory requirements.
7.4 We are not responsible for any third party content or sites we link to or which are framed on our site.
7.5 Any liability of Certsure in relation to the Job Board is excluded and limited so far as is legally possible, and as described here and in the Website Terms of Use.
7.6 We may change the Job Board and how it works at any time with or without notice.
8 Obligations on you
8.1 By accessing and using the Job Board, you accept and agree to comply, and continue to comply for the duration of your access and use, with all terms set out in the Website Terms of Use, which also apply to your use of the Job Board, and the NICEIC Scheme Rules, and in addition you specifically agree not to:
8.1.1 use the Job Board to provide services to third parties or for resale purposes; and
8.1.2 license, sell, rent, distribute or otherwise commercially exploit the Job Board or make it available to any third party.
9 Data protection
9.1 Our Privacy Policy sets out any personal data we collect and how we process that personal data in relation to the Job Board.
10 Other provisions
10.1 From time to time we may update or amend these terms or the Job Board itself, with or without notice. You will be deemed to have agreed to those updated or amended terms if you continue to use the Job Board following their updating or amendment.
10.2 Nothing in these terms is intended to or shall operate to create a partnership between you or us, or anyone else, nor authorise any party to act as agent for the other.
10.3 The Jurisdiction and Dispute rules set out in the Website Terms of Use apply to these terms.

3 How the Job Board works
3.1 You do not need to register or subscribe in order to browse or search the Job Board. To apply for an apprenticeship opportunity posted on the Job Board, you need to first register a basic profile. This will require you to confirm you are 18 or older.
3.2 The Job Board is free for your own personal use in accordance with these terms.
3.3 We receive no commission based on whether you obtain an apprenticeship via the Job Board or not.
3.4 The Job Board provides functionality to help introduce you to NICEIC Certified Businesses who are offering apprenticeship opportunities. We do not act as agent for any NICEIC Certified Businesses, or for you and we make no guarantee or promises about any opportunities offered by the NICEIC Certified Businesses.
3.5 To register for a basic profile and to apply for an apprenticeship posted on the Job Board, you must provide certain requested information - that information will be shared with NICEIC Certified Businesses to which you apply for an apprenticeship opportunity. This may include:
3.5.1 your name and confirmation that you are over 18;
3.5.2 basic contact information (including email address and telephone number);
3.5.3 your address;
3.5.4 any relevant credentials; and
3.5.5 any other information reasonably requested for the purposes of considering your suitability for an apprenticeship.
3.6 We do not guarantee that there will be any apprenticeship opportunities on the Job Board, or that you will obtain an apprenticeship via the Job Board.
4 Job Board listings and ranking
4.1 There are no preferential listings, or other paid ranking system underlying the opportunities presented on the Job Board. The apprenticeship opportunities are posted the order of most recently posted if just browsing, or in order of how closely they match your search criteria if you are making a search. Certsure does not make any recommendations about apprenticeship opportunities appearing on the Job Board.
4.2 The apprenticeship opportunities listed on the Job Board may include basic details of the relevant NICEIC Certified Businesses and what they are offering. This is prepared by them, not Certsure. Certsure cannot therefore be responsible, and is not responsible, for the accuracy or reliability of any content posted on the Job Board. Further information about the apprenticeship opportunity may be provided directly by the NICEIC Certified Business outside of the Job Board. We make no promise that the NICEIC Certified Business will engage with you outside of the Job Board or in relation to how they may engage with you. It is your responsibility to make your own enquiries about any opportunity presented on the Job Board before proceeding.
5 Applying
5.1 You may contact a NICEIC Certified Business to apply or to find out more about any apprenticeship opportunity posted on the Job Board.
5.2 Where you choose to apply or to find out more about an apprenticeship opportunity, you agree to provide the requested information in order that NICEIC Certified Business may consider you and contact you should they choose.
5.3 We do not guarantee that a NICEIC Certified Business will contact you or respond to you, or provide you with an apprenticeship after you have applied.
6 Decision to undertake an apprenticeship
6.1 It is a matter for you and the relevant NICEIC Certified Businesses to decide between yourselves whether to work together and take up an apprenticeship. The NICEIC Certified Business will be the one to decide whether to offer you an apprenticeship opportunity and on what terms. You are not obliged to enter an apprenticeship based on an application alone, and if you do engage with them, that is a matter for you and them to agree and formalise between yourselves, not Certsure.
6.2 Any apprenticeship opportunity provided by a NICEIC Certified Business, is subject to their terms and internal processes for how they administer such apprenticeships.

6.4 You acknowledge and agree that it is your responsibility to make your own enquiries to satisfy yourself that a NICEIC Certified Business meets your requirements, including that they comply with any schemes, standards, laws, codes, certifications or regulatory requirements and otherwise has the credentials you need or would like in relation to an apprenticeship opportunity and that it is right for you.
6.5 Certsure is specifically not responsible for:
6.5.1 the accuracy, quality, safety or legality of any NICEIC Certified Businesses, their apprenticeships that they offer, their services generally, or their acts or omissions;
6.5.2 whether or how an NICEIC Certified Business co-operates with you or responds to your application or enquiry;
6.5.3 any services of the NICEIC Certified Businesses, any engagement, arrangement, meeting or communication you have with them; and
6.5.4 so far as is permitted by law, any liability, loss, damage, injury, cost, expense, fine, demand, claim or proceeding incurred by any person whatsoever in connection with your use of the Job Board and/or any interaction or engagement of any kind with any NICEIC Certified Business or provision of their services.
7 Access and service level

10.2 Nothing in these terms is intended to or shall operate to create a partnership between you or us, or anyone else, nor authorise any party to act as agent for the other.
